Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period expires fourteen days after the day on which you, or a third party designated by you other than the carrier, take possession of the last item of goods.

How to withdraw

To exercise your right, you must inform us (EATC GmbH, Karlsruher Str. 129, 01189 Dresden, Germany, telephone +49 351 40 28 17 60, email kontakt@smarald.com) of your decision to withdraw through an unequivocal statement, for example a letter sent by post or an email. You may use the model form below, but this is not compulsory. You can also withdraw online using the ‘Withdraw from contract’ button in the footer of our website. If you use this online function, we will promptly email an acknowledgement including the content of your withdrawal statement and the date and time of receipt. To meet the deadline, it is sufficient to send your withdrawal statement before the withdrawal period expires.

Effects of withdrawal

If you withdraw, we will reimburse all payments received from you, including delivery costs, except additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us. Reimbursement will be made without undue delay and no later than fourteen days after we receive your withdrawal statement. We will use the same means of payment as your original transaction unless expressly agreed otherwise; you will incur no reimbursement fee. We may withhold reimbursement until we have received the goods back or you have supplied evidence of returning them, whichever is earlier.

Returning goods

You must send back or hand over the goods to EATC GmbH, Karlsruher Str. 129, 01189 Dresden, Germany, without undue delay and no later than fourteen days after informing us of your withdrawal. The deadline is met if you send the goods before that period expires. You bear the direct cost of returning the goods. You are liable for diminished value only where it results from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
